Law LL.B
For courses that run over 2 semesters, a pass (60 and above) is required at the end of the first semester before enrollment in the second part of the course. However students with a grade of 50 and above may enroll for the second part within the same academic year; students with a grade of 40-49 may apply to the relevant lecturer for permission to enroll and proceed if granted acceptance; students with a grade of 0-39 may not enroll in the second semester within the same academic year.

  • Ph D (Law)

Article 29 Entrance exam
Persons who have passed the entrance exam for the PhD or been upgraded from the LL.M programme may register in the PhD programme.

Qualifying conditions for taking the entrance exam
Basic Condition a graduate with an LL.M degree in law, for which a thesis was presented, from any university or college at home or abroad recognized by the Ministry of Education a graduate with a LL.B degree in law or financial and economic law and with an LL.M degree for which a thesis was presented, from any university or college at home or abroad recognized by the Ministry of Education a level of academic ability comparable to the above as determined by the Ministry of Education

*Fulfillment of these credits does not fulfill the requirement for the PhD(LL.D) course itself.

The entrance exam comprises 3 parts:

Articles 30-31 Area and Length of study

Area of study choose 1 area of study from the following 4:
(i) basic law;
(ii) civil law;
(iii) criminal law;
(iv) public law
Condition plan of study must conform to chosen area
Alteration

Exceptionally the Dept Head may permit a student to change their chosen area of study, in which case the student must take the required credits in the new area of study.

Length of study 3-7 years (6-14 semesters)
Absence permissible 6 semesters

Article 32

*NB When there are not sufficient appropriate courses offered at PhD level, permission from the Head of the Dept is required before a student chooses courses offered at LL.M level in the Department of Law or in the Department of Law of F & E.

Essays Each semester the student must write an essay of at least 10,000 Chinese characters to be marked by the teacher responsible for the course taken. The essay is to be handed in within one month from the last day of the semester. Late essays must be marked 'fail'. If the essay is not delivered one week before the next semester begins the student's grade is to be zero.
One of the student's essays written during the course of studies is to be submitted to Fu Jen Law Review.
Resits Students who resit the entrance exam may count the credits of subjects in which they have already attained a passmark. Such credits must not exceed 2/3 of the total number of credits.

Article 33 Choice of Director of Thesis

Time of choice Students must select their thesis director before the end of their second academic year. The selection must be discussed with the Head of Dept. who alone can give permission.

*Full-time professors of the School of Law who do not teach in this field can inform the Head of Dept. and the Dean, who may then invite a part-time professor to serve.

LL.M thesis, plan of study presented on entrance to the PhD programme, published works, list of courses taken and marks gained, preliminary title of the PhD thesis and plan of study
arrow The director should then meet the student and set out the requirements for study, which may include the taking of certain courses or study of certain books.
arrow The director may then accept the student and sign a form to be given to the student. A copy must be sent to the PhD office for approval.

Article 34 Registration Rules

Registration with PhD thesis office After the title of the thesis has been approved the student must re-register with the PhD thesis office in the first two weeks after the semester begins.
Major changes to thesis To be agreed to in writing by the thesis director and Head of Dept. This procedure may only be done once.
Director incapacitated
PhD office must be notified in writing that the director is giving up the direction of a given student. PhD office must then help the student to find another director.
Changes to the thesis must be registered with the PhD office; the student must also take all relevant courses taught by the new director at PhD and LL.M level.

Article 35 Qualifying norms

After completing all required courses and at least two years of study and signed an agreement with a thesis director may then register to write the PhD thesis. Within the first two weeks of every semester the student may apply for the registration exam. The thesis is to be completed within seven years since registering on the PhD programme.

Requirements
(i) Draft Thesis of 100,000 Chinese characters (including notes).
(ii) One Article (of at least 10,000 Chinese characters) on a topic related to the thesis accepted for publication in a foreign-language journal

One of the articles (published or to-be-published) must be included in Fu Jen Law Review.

One subject in the area of study (see lists of subjects)* exam in a foreign language (of law) (French, German or Japanese) (see qualifications)*
(iv) Committee of 2 Professor or Associate professors or experts from the university or outside the university. If the marks of the two differ such that one is below 70%, then a third person is to be sought. The average of the three must be over 70.

Article 36

Public presentation of thesis
The student is to recommend a list of 12 or more scholars to attend the public presentation and to provide the requisite number of copies of the draft thesis. The presentation should take three hours in all. The student is to record opinions presented orally or in writing and to type up the record and show it to the thesis director and invited scholars. The thesis is to be rewritten in conformity with the opinions expressed.

Article 37

Committee for defence
Committee of 5 to 9 persons chosen by the President of the University on the recommendation of the Head of Dept based on a list of at least 12 persons provided by the thesis director. If the number proposed by the director falls short of 12, the Head of Dept may invite others to complete the number. The chair of the committee is to be appointed by the Head of Dept. at least 1/3 of the committee should be from outside Fu Jen University. The thesis director must take part but is not to chair the committee.
